By accessing or using the website located at antiochdeckandfence.com (the "Site"), or by entering into a service agreement with Antioch Deck & Fence ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, do not use the Site or engage our services. These terms may be updated at any time, and continued use of the Site or our services after any update constitutes acceptance of the revised terms.
Antioch Deck & Fence provides residential and commercial deck building, fence installation, pergola construction, patio cover installation, and related outdoor structure services in Antioch, CA and surrounding Contra Costa County communities.
All services are provided subject to a written agreement between the Company and the customer. No service obligation is created by a request submitted through the Site alone. A signed contract and any required deposit are required before work begins.
Estimates provided by Antioch Deck & Fence - whether by phone, email, or in person - are based on the information available at the time of the estimate and are subject to change. A written proposal is required before any work begins and constitutes the agreed scope and price.
If conditions discovered during the project differ materially from those present at the time of the estimate - such as concealed structural damage, unanticipated site conditions, or changes requested by the customer - the Company will notify the customer in writing and obtain approval before proceeding with additional work. Additional work beyond the original written proposal will be priced and authorized separately.
Prices are subject to change based on fluctuations in material costs, labor rates, or permit fees not foreseeable at the time of the estimate. The Company will communicate any material changes in writing before proceeding.
Project start dates are scheduled once a signed contract and any required deposit have been received. Start dates are estimates and may be subject to adjustment due to permit review timelines, material availability, weather conditions, or other factors outside the Company's control.
Either party may cancel a signed contract with written notice. If a customer cancels after work has begun, the customer is responsible for the cost of all labor performed, materials purchased or ordered, and any permit fees paid on their behalf up to the date of cancellation. Any deposit paid will be applied against those costs.
If the Company must postpone or reschedule due to circumstances beyond its control, it will provide the customer with reasonable notice and a revised start date as soon as practicable.
Payment terms are specified in the written contract for each project. A deposit may be required before work begins. Final payment is due upon completion of the project and customer sign-off, unless otherwise stated in the written agreement.
Invoices not paid within the timeframe specified in the contract may be subject to a late payment fee as set forth in the written agreement. The Company reserves the right to suspend or discontinue work on a project if payment obligations are not met.
Accepted payment methods will be communicated at the time of contract execution. All prices are in United States dollars.
For projects requiring building permits, Antioch Deck & Fence will apply for and manage the permit process with the applicable local authority on behalf of the customer, unless the written contract states otherwise. Permit fees are the responsibility of the customer and will be itemized in the written proposal.
The customer is responsible for ensuring that the project complies with any applicable homeowners association (HOA) rules, deed restrictions, or other private covenants. The Company will work with the customer to understand HOA requirements but is not responsible for delays or redesigns caused by HOA rejection of plans that were not disclosed to the Company prior to the start of the design process.
Any workmanship warranty provided by Antioch Deck & Fence will be stated in the written contract for each project. Warranty terms vary by project type and material.
Material warranties, if any, are provided by the respective manufacturers and are subject to those manufacturers' terms and conditions. The Company will assist customers in understanding applicable manufacturer warranties but does not extend or supplement manufacturer warranties beyond what the manufacturer offers.
Warranties do not cover damage caused by misuse, improper maintenance, acts of nature, settlement caused by soil movement not attributable to improper construction, or modifications made by any party other than Antioch Deck & Fence. The Site and any information on it is provided "as is" without warranty of any kind, express or implied.
To the fullest extent permitted by applicable law, Antioch Deck & Fence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the Site, or any services provided, even if the Company has been advised of the possibility of such damages.
The Company's total liability for any claim arising out of a service agreement shall not exceed the total amount paid by the customer to the Company under that specific agreement. This limitation applies to the maximum extent permitted by law and does not apply to claims arising from the Company's gross negligence or willful misconduct.
All content on the Site - including text, images, graphics, logos, and design elements - is the property of Antioch Deck & Fence or its content licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from the Site for commercial purposes without prior written permission from the Company.
In the event of a dispute arising out of or relating to these Terms or any service agreement, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If negotiation does not resolve the dispute within 30 days, either party may pursue resolution through mediation before initiating any legal action.
If mediation does not result in a resolution, the parties may pursue their respective legal remedies. Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief where necessary to prevent irreparable harm.
These Terms and Conditions and any service agreements between you and Antioch Deck & Fence are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought in the state or federal courts located in Contra Costa County, California, and you consent to the personal jurisdiction of those courts.
Antioch Deck & Fence reserves the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site or our services after any change constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
